Terms of use

Who we are

Whisp3r is operated by Adaptive Query LLC ("we", "us"). When these terms say "Whisp3r" or "the app" they mean the corporate app served from whisp3r.com, not the underlying protocol — that is documented separately and can be self-hosted by anyone. When these terms say "you" they mean the individual signed in.

Eligibility

You must be at least 13 years old to use this app. Some features additionally require you to be 16, 18, or 21; those features gate themselves on the age-tier claims published by Whisp3r Auth. If you misrepresent your age to defeat one of those gates we may suspend the account.

You may only use the app in jurisdictions where it is legal to do so. If a court or regulator in your jurisdiction orders us to restrict your access, we will comply.

Your account

Your identity on Whisp3r is owned by your Whisp3r Auth account. We never see your password, we never see your email, and we never see any cross-app correlation identifier — the pairwise sub claim we receive is unique to this app and opaque to every other app you connect to the same Whisp3r Auth account.

Per-app handle rules:

• Your @handle is yours so long as it stays current in Whisp3r Auth. When you rename it on auth, the new handle propagates to this app within seconds and the old handle stays reserved for 30 days (during which only you can take it back). After 30 days it returns to the public pool.
• Disconnecting this app at Whisp3r Auth is the gateway to either deleting or archiving your data — see the Privacy document for the full contract. There is no separate "delete my Whisp3r account" surface here because the revoke flow already does it.

Content you post

You retain ownership of the posts, comments, reactions, and media you contribute through this app. By posting them here, you grant us a non-exclusive, royalty-free, worldwide licence to host, display, transmit, and back up that content for the purpose of operating the app. The licence lasts only as long as the content exists on our service — if you delete it (or revoke access with intent=delete), the licence ends and we purge our copies.

Posting content does NOT transfer copyright to us. You can move the same content to a self-hosted Whisp3r anchor at any time.

What you may not do

You agree not to:

• Use the app to harass, threaten, or impersonate another person.
• Post content that is illegal where it is hosted, where it is received, or where it is authored.
• Distribute malware, exploit kits, or content designed to compromise other users' accounts or devices.
• Scrape the app at scale, attempt to defeat rate limits, or run automated agents on the public surfaces without prior written agreement. The protocol has a documented federation contract for that use case — use it.
• Submit content that infringes someone else's intellectual property, privacy, or publicity rights.
• Use the app to develop a competing service through reverse-engineering of our hosted infrastructure. The protocol itself is open and you may build on it directly without going through this app.

Suspension and termination

We may suspend or terminate your access if you violate these terms or if continuing to serve you exposes us or other users to legal risk. We will, where lawful and feasible, let you know before doing so and give you a chance to export your content.

You may end your use of the app at any time by revoking this app's access at Whisp3r Auth. See the Privacy document for what happens to your stored content based on the intent you select on the revoke screen.

No warranties

The app is provided "as is." We do not warrant that it will be uninterrupted, error-free, or that any defect will be corrected on a specific timeline. Outages happen; your local content lives until it leaves your device.

Limits on liability

To the maximum extent permitted by law, our aggregate liability to you arising out of or relating to your use of the app is limited to the greater of:

• The amount you have paid us in the previous twelve months, or
• One hundred US dollars (USD $100).

Neither party is liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, even if advised of the possibility.

These limits don't restrict liability that can't be excluded by applicable law (gross negligence, willful misconduct, certain consumer-protection rights).

Changes to these terms

We may revise these terms over time. Material changes (those that expand restrictions, change ownership of content, or shorten retention) require a fresh consent screen at Whisp3r Auth before they take effect for your account. Non-material clarifications are republished here without a re-consent.
